They've loosened up on at least one of those fronts in the last year or so, expanding the types of apps available in the App Store, but manyscrew that, mostof the same restrictions still apply. Want to install an app that Apple hasn't explicitly approved? Sorry. Want to use an app over 3G that's been designated for Wi-Fi? Nope. Want to tether your phone? Run applications in the background? Change your device theme? Install system-wide gestures? No. Such. Luck.

Enter jailbreaking. In technical terms, to jailbreak is to enable a device to run code, meaning programs or system modifications, that hasn't been sanctioned by Apple. Its roots reach back to a time when there were no apps for iPhone OS, and a clever group of hackers zeroed in on some exploits gave people their first way to install apps on their devices, by way of an underground App Store called Installer. It used to be that you could hack your device simply by visiting a webpage. That was two years ago. Since then, the iPhone and iPod Touch have been given a legit App Store, Apple has closed one security hole after another, and jailbreaking has become alternately more and less difficult, depending which device and software version you have.

But just last week, a Windows and Mac tool called Spirit was released to the world. It's simple, relatively safe, and finally, works on all devices. Every iPod Touch can now be jailbroken to run custom apps. Every iPhone, too. Even the brand new iPad can be hacked. Theming, data tethering, multitasking, console emulation, secret settings, and yes, you filthy thief, even pirated apps: With jailbreak, your iThing is truly yours.

Here's how to jailbreak (or in the case of phones, unlocked) any iPod Touch, iPhone or iPad, using the new Spirit tool. But first, a disclaimer:

When you jailbreak or unlock a device, you're chaining some fundamental aspects of the system softwareyou know, real low-level stuff. The tools are generally good, and if you follow directions carefully, you should be fine. But if something goes wrongand there is more than one way this can happenyou can suffer data loss, or even brick your phone. Even worse, Apple claims that jailbreaking voids your warranty. You can restore your device to remove evidence that it ever happened, but if the device goes down while jailbroken, you could well be stuck. In addition, jailbreaking does not jibe with the DMCA, and breaks relate license agreements.

To the point: Follow this guide at your own peril, know that there's risk and be careful. Consult elsewhere if you're nervous, or worry that I've missed something.

How To Jailbreak

The Spirit tool has made the jailbreak fairly simple, but there's still room for error. Step by step:

1. Plug your device in, so that it's recognized by iTunes 2. Back up your device to your iTunes library, and sync it. Open the Spirit Jailbreak tool. It will open in a small window, and should display a message like "iPad (3.2) Connected." If not, disconnect and reconnect your device, and open the tool again. 4. Click "Jailbreak" 5. During the jailbreak routine, don't interfere with the device. It's probably better to leave your computer alone as well, to avoid a crash at a critical moment. First, you should see a screen on the device that says "Restore Complete." The device will restart, display a spinning pinwheel icon, and open up a colorful screen like this, with a progress bar:

Spirit should be done doing its thing in under 30 seconds. Your device should then boot up to your homescreen, as it was beforesame background, same apps, same settings. Now you're jailbroken. But there's one more thing:

6. When you restart your device, you'll see a new icon on your homescreen, called Cydia. Open it up. This is your new App Store. Don't worry, the regular App Store still works. Now you've just got another one.

Cydia will look a bit different on the iPad and iPhone or iPod Touch, but will contain most of the same software.

The first thing you need to do, though, is click the button that says, "Make my life easier, thanks!"

This will back up your device activation profile (called an SHSH blob) to remote servers, which ensures that you won't lose the ability to jailbreak if you accidentally upgrade your device device software in the future. More on that later.

Regarding Unlocking

Traditionally, unlocking (opening your phone to use with different carriers) and jailbreaking have fallen to the same tools. Since unlocking has become more difficult with later firmwares, the tools have grown apart. Spirit doesn't unlock. If you want to unlock, though, there may be hope.

If you haven't upgraded your iPhone to firmware 3.1.3, or can downgrade to an earlier build, you can use the Pwnage Tool, located here. The process is self-guided and quite similar to using Spirit. New Government Rules Regarding Iphone Apps

Owners of the iPhone will be able to legally unlock their devices so they can run software applications that haven't been approved by Apple Inc., according to new government rules announced Monday.

The decision to allow the practice commonly known as "jailbreaking" is one of a handful of new exemptions from a 1998 federal law that prohibits people from bypassing technical measures that companies put on their products to prevent unauthorized use of copyright-protected material. The Library of Congress, which oversees the Copyright Office, reviews and authorizes exemptions every three years to ensure that the law does not prevent certain non-infringing uses of copyright-protected works.

For iPhone jailbreakers, the new rules effectively legitimize a practice that has been operating in a legal gray area by exempting it from liability. Apple claims that jailbreaking is an unauthorized modification of its software.

Mario Ciabarra, founder of Rock Your Phone, which calls itself an "independent iPhone application store," said the rules mark the first step toward opening the iPhone app market to competition and removing the "handcuffs" that Apple imposes on developers that want to reach users of the wildly popular device.

Unless users unlock their handsets, they can only download apps from Apple's iTunes store. Software developersmust get such apps pre-approved by Apple, which sometimes demands changes or rejects programs for what developers say are vague reasons.

Ciabarra noted that Google Inc. has taken a different approach with its Android operating system, which is emerging as the biggest competitor to the iPhone. Google allows users of Android phones to download applications from outside the Android Market.

Although Apple has never prosecuted anyone for jailbreaking, it does use software upgrades to disable jailbroken phones, and the new government rules won't put a stop to that. That means owners of such phones might not be able to take advantage of software improvements, and they still run the risk of voiding their warranty.

Apple spokesman Natalie Kerris said Monday that the company is concerned about jailbreaking because the practice can make an iPhone unstable and unreliable.

"Apple's goal has always been to ensure that our customers have a great experience with their iPhone, and we know that jailbreaking can severely degrade the experience," she said.

In addition to jailbreaking, other exemptions announced Monday would:

allow owners of used cell phones to break access controls on their phones in order to switch wireless carriers.

allow people to break technical protections on video games to investigate or correct security flaws.

allow college professors, film students, documentary filmmakers and producers of noncommercial videos to break copy-protection measures on DVDs so they can embed clips for educational purposes, criticism or commentary.

allow computer owners to bypass the need for external security devices called dongles if the dongle no longer works and cannot be replaced.

allow blind people to break locks on electronic books so that they can use them with read-aloud software and similar aides.

Although the jailbreaking exemptionis new, all the others are similar to the last set of exemptions, which were announced in November 2006. The new rules take effect Tuesday and are expected to last a few years.

The exceptions are a big victory for the Electronic Frontier Foundation, which had urged the Library of Congress to legalize several of them, including the two regarding cell phones.

Jennifer Stisa Granick, EFF's civil liberties director, said the rules are based on an important principle: Consumers should be allowed to use and modify the devices that they purchase the way they want. "If you bought it, you own it," she said.

How to Use Cydia for Jailbroken iPhone or iPod Touch

So, you've finally taken the plunge and jailbroken your iPhone. (Jailbreaking is modifying your phone's system files so that you can install themes, programs, etc. that aren't approved by Apple). The only differences that you can see are that there are now a couple of extra icons on your phone menu. One of them is called Cydia.

Cydia has been called the App Store for jailbroken iPhones. I don't really like that comparison because there aren't too many games and productivity apps available in Cydia since the iTunes App Store opened. It's mostly a place to obtain themes,ringtones, system utilities, etc. Some of which will make your iPhone experience so much better than an non-jailbroken phone! It is where you get the tools to make your iPhone truly yours!

Here are the steps to use Cydia after it's been installed through the jailbreaking process. This article assumes that you have already jailbroken your iPhone.

Step 1: Tap on the Cydia icon on your iPhone hoe screen and you will see Cydia main screen. Here you will find important information from the developer, along with some lists of pay applications (Cydia Store Products), FAQs, and a few How-To articles.

Step 2: Next, you will want to browse products, or packages as they are called in Cydia, that are available by tapping on the "Sections" button at the bottom of the screen. You will see a list of everything available, divided up into sections or categories.

If you Press All Packages, you will see everything available to you, but there are thousands and will be overwhelming. It's better to browse the sections and find packages that are interesting to you. For example, there are sections for Ringtones and Themes.

Step 3: Next, tap the "Search" button at the bottom of the Cydia screen. You will see a screen that only has a search box at the top. Tap the field to bring up your keyboard. Enter "BossPrefs" in the search field and press "Search".

Go down to the "B's" and when you find BossPrefs, tap on it.

Step 4: You will now see the Cydia detail screen for BossPrefs. With most packages, you can scroll down and see additional information. For example, with theme packages, you might see "Screenshots". Or you might see a changelog so that you can see what has changed in different versions of a package.

If you'd like to install this app, press the install button in the top of the detail screen.

Step 5: You will now see a confirmation screen, showing you the size of the package that you are about to install. Press "Confirm" to continue with the install.

Step 6: You will now see a black screen with words going across it. Don't worry, you don't need to know! When the installation is complete, you will see a button telling you either to "Return to Cydia" or "Restart Springboard".

It will have to exit Cydia and restart the Springboard for certain types of apps, including packages that mess with the iPhone's operating system. If it does, just wait for it to come back to your iPhone menu.

Step 7: If you go back to the iPhone home screen, you will now see your package, or application, installed.

Step 8: Now go back to your Cydia application and tap the "Manage" button. You will see three options. "Storage" will let you know how much room that you have to install more applications.

"Sources" will let you add more sources, or locations where additional packages can be found by Cydia. See the Tips for additional information. Press "Edit" to add the additional sources.

"Packages" will show you what is currently installed on your iPhone. Many of the packages that you will see here are installed by the jailbreak. This is where you will remove applications. I'll show you how in the next step.

Step 9: Press "Packages" under the "Manage" menu item (at the bottom of the Cydia screen). If you want to delete an application, scroll down to the package that you want to install.

To delete, tap on the "Modify" button in the top right of the screen. It will ask you to confirm and then it will delete.

Step 10: For the last option, you can select the "Change" option at the bottom of the Cydia scree. The screen that you see will tell you which of the packages that you have installed have available updates. (You can look at the changelog in the package details to see what has changed.) It will also tell you all of the new packages that have been added. It's a great place to browse for new, exciting packages!

Take some time to browse the different sections. You will find that Cydia is where you will find the iPhone modifications that will make you happy that you made the effort to jailbreak!
